Agreement


 

Preamble
  1. The Foundation and the Association declare their intention to work together on the electronic conservation and the internet distribution of all documents relevant to the life and work of Freidrich Nietzsche that are in the possession of and are the property of the Foundation, insofar as this will not infringe upon the rights of any third party.

  2. The parties intend to support scholarly research on Nietzsche, to integrate research and digital archives more efficiently, and to increase the scholarly value of the digitized material through internet distribution.

  3. In order to implement these plans, the Foundation and the Association agree to the following:

Granting of License by the Foundation
  1. The Foundation grants permission to the Association to digitize or to cause to be digitized the original works by Nietzsche that are in the possession of the Goethe and Schiller Archives, including manuscripts, letters, and biographical documents. Excepted from the present agreement is Nietzsche’s philosophical Nachlass from 1885-1888.

  2. The Foundation grants permission to the Association to digitize or to cause to be digitized the first editions and errata sheets of Nietzsche’s works that belong to the holdings of the Duchess Anna Amalia Library, as well as of the volumes in his personal library, as listed in the index compiled by G. Campioni, P. D’Iorio, M. C. Fornari, F. Fronterotta, and A. Orsucci.

  3. The Association may publish the prepared reproductions on the internet at no cost for purely scholarly purposes, and may to this end edit them digitally.

  4. The Association is permitted to allow the users of its internet domain to make use of the reproductions of the above-mentioned works for purely scholarly purposes. To use the reproductions for anything other than purely scholarly purposes, in particular for any commercial purposes, users are required to request permission directly from the Foundation.

  5. This is a matter of simple licenses.

  6. The granting of license is free of charge.

Acknowledgment Requirements for Internet Publication

For every internet publication that is made possible through the agreement with the Foundation, the Association will acknowledge the cooperation of the Foundation.
