Any contribution published in HyperNietzsche will naturally be subject to the laws which regulate copyright: indeed, there is no reason why a text published on the Internet would not have the same legal protection that is granted to an essay published in book form. However, in the context of academic research, what generally interests scholars more is the widest possible distribution of their work. For this reason, the lawyers participating in the HyperNietzsche project have developed three copyleft use-licenses, which, while strictly observing the intellectual property and moral rights of the author, allow everyone to consult the primary sources and critical contributions but do not give anyone exclusive rights to this material.
The HyperNietzsche Association itself, unlike traditional editors, does not acquire the material which is entrusted to it for publication. With a use license, which is executed electronically at the moment a text is published on line, the author does not actually yield to HyperNietzsche any right to the text, not even the exclusive right to publish it on the Internet. The author is thus free to publish the text again in any medium. The only thing to which the author agrees is to leave the text available on HyperNietzsche for a period of ten years (potentially renewable).
Finally, it should be emphasized that HyperNietzsche is not limited to the publication of new texts. Rather, it seeks to integrate the majority of texts written on Nietzsche (those that have passed an examination by editorial board), even those that have already been published elsewhere. In cases where the author did not sign a contract transferring the rights (as is normal in the case of articles published in journals) or in cases where the signed contract does not explicitly address the issue of the right to publish in electronic media (as in most contracts exsecuted before the Internet revolution), the author retains the right to publish in electronic media. The author is therefore free to republish the text in HyperNietzsche with worldwide distribution and with all the benefits of dynamic contextualization.
